you need to define the namespace "http://www.w3.org/2001/XMLSchema-instance" of the nil attribute in the xml request as following:
<myElement xsi:nil="true"
xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance"/>
Your customers should be fine with that. I am not sure what you need to achieve, maybe if you also post the XSD and the XML request, it will become more clear.
